1. Agreement to Terms

By accessing or using RacetrackDesign ("the Service"), operated by RacetrackDesign ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

RacetrackDesign is a web-based tool for designing and analysing race circuit layouts. The Service includes free and paid subscription tiers, each with different feature access as described on our pricing page.

3. Accounts

To access certain features you must create an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must provide accurate information when registering and keep it up to date.

4. Subscriptions and Billing

Paid features are available through subscription plans billed monthly or annually. Payments are processed securely by Stripe. By subscribing, you authorise us to charge your payment method on a recurring basis until you cancel.

You may cancel your subscription at any time from your billing page. Cancellation takes effect at the end of the current billing period — you retain access to paid features until then. We do not offer prorated refunds for partial billing periods.

We reserve the right to change pricing with 30 days' notice. Price changes apply to the next billing cycle after the notice period.

5. Your Content

You retain ownership of the track designs and data you create using the Service ("Your Content"). By using the Service, you grant us a limited licence to store, process, and display Your Content as needed to provide the Service to you.

You are responsible for ensuring you have the right to upload any content you provide.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorised access to the Service or its systems
• Interfere with or disrupt the Service's infrastructure
• Scrape, crawl, or use automated means to access the Service beyond normal use
• Resell or redistribute the Service without our written permission

7. Intellectual Property

The Service, including its design, code, branding, and documentation, is owned by RacetrackDesign and protected by intellectual property laws. Nothing in these Terms grants you rights to our trademarks or branding.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. Track analysis results, including safety assessments and lap simulations, are for informational and educational purposes only. They should not be relied upon as professional engineering advice for real-world circuit construction.

9. Limitation of Liability

To the maximum extent permitted by law, RacetrackDesign shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the Service.

Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including limitations of liability and intellectual property) will remain in effect.

11. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes via email or a notice on the Service. Continued use after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
